Security Officers at Fort Sam Houston Sue Walden Security for Unpaid Overtime.

On November 17, 2010, The Young Law Firm PC filed suit against Metropolitan Security Services, Inc. d/b/a Walden Security for not properly paying overtime to security officers it employed at Fort Sam Houston in San Antonio, Texas. A copy of the lawsuit can be found here. The lawsuit claims that Walden Security violated federal law by failing to pay security officers for meal breaks during which the officers continued to work and by failing to include so-called health and wellness payments in calculating the officer’s overtime pay. On March 15, 2011 the U.S. District Court for the Western District of Texas entered an order conditionally certifying a class of similarly situated employees and authorized sending notice to the security officers alerting them of their right to join the case. More than 100 security officers joined the lawsuit during the court-ordered opt-in period. Also on March 15, 2011, the Court denied Walden Security’s attempt to dismiss the case. The Court observed that Walden’s failure to include its health and wellness benefits payments in calculating overtime for security officers was in violation of federal law.
