Mi Tierra Cafe and Bakery Sued for Tip Pooling Violations.

Virginia Barrera, a server at Mi Tierra Cafe and Bakery in San Antonio, Texas filed suit on August 11, 2010 against her employer claiming that she and other servers are illegally required to share their tips with non-service bartenders in violation of the Fair Labor Standards Act. A copy of the lawsuit can be found here. On March 1, 2011 The U.S. District Court for the Western District of Texas granted Barrera’s motion for conditional certification of a class and authorized The Young Law Firm, PC to send written notice to other servers, giving them an opportunity to join the lawsuit. Including Barrera, 40 current or former employees joined the lawsuit during the court-ordered opt-in period.
